PHÚC LỢI NHÂN VIÊN 2026: TỔ CHỨC SINH NHẬT, TIỆC CHO NHÂN VIÊN CẦN LƯU Ý NGHĨA VỤ HÓA ĐƠN ĐẦU RA (GIỐNG TRƯỜNG HỢP QUÀ TẶNG)
AI Coaching Vietnam (www.AiCoachingVietnam.com) khuyến nghị doanh nghiệp rà soát "Employee Benefit Policy" (chính sách phúc lợi danh cho nhân viên) thay vì chỉ xử lý từng giao dịch khi phát sinh. Các khoản nên đưa vào phạm vi review bao gồm sinh nhật, Year End Party, company trip/nghỉ mát, hiếu hỷ, khám và chăm sóc sức khỏe, bảo hiểm, quà lễ/Tết, voucher, hỗ trợ đi lại, hỗ trợ học tập, hỗ trợ đặc biệt, wellbeing program và các khoản thưởng/phúc lợi phi tiền mặt.

---------------------------------------------- EMPLOYEE BENEFITS 2026: BIRTHDAY PARTIES AND EMPLOYEE EVENTS – OUTPUT INVOICE OBLIGATIONS REQUIRE ATTENTION (SIMILAR TO GIFTS)
1. Key Update:
On 20th October 2026, the Government Electronic Newspaper published guidance from the Khanh Hoa Provincial Tax Authority regarding a case where a company organized monthly birthday parties for its employees at a restaurant. https://baochinhphu.vn/chi-phi-to-chuc-sinh-nhat-cho-nhan-vien-co-phai-lap-hoa-don-dau-ra-102261020110819285.htm
According to the published guidance, where a company organizes birthday celebrations for employees in the form of meals at a restaurant, the company is required to issue an output invoice, pursuant to Clause 1, Article 4 of Decree No. 254/2026/ND-CP.

Previously, such expenses were generally understood and treated as "other employee welfare expenses", subject to the limit of one month’s average actual salary when calculating CIT.
- If the total qualifying welfare expenses donot exceed one month’s average actual salary implemented during the tax year, the full amount of such qualifying welfare expenses may be treated as deductible expenses for Corporate Income Tax (“CIT”) purposes, subject to the applicable conditions. - If the total qualifying welfare expenses exceed one month’s average actual salary, the portion exceeding this limit will not be deductible for CIT purposes. - Input Value Added Tax (“VAT”) may still be creditable, subject to the applicable VAT credit conditions (e.g. recorded under Dr. VAS Account 133).
However, this update is particularly noteworthy because expenses commonly managed by businesses as "employee welfare / employee engagement” may simultaneously trigger obligations relating to: Input Invoice (Dr. 133) → Output Invoice Requirement (Cr. 333) → VAT → CIT → PIT → Accounting → Supporting Documentation.
Accordingly, the fact that a supplier has issued a valid invoice bearing the company’s tax identification number does not, by itself, mean that the related input VAT will automatically be creditable or that the expense will automatically be deductible for CIT purposes.
2. What Should Businesses Pay Particular Attention To?
Input invoices and output invoice obligations should be reviewed separately. For example, a company engages a restaurant to organize a birthday party for its employees and receives a proper invoice from the restaurant.
Traditionally, the Accounting team may focus primarily on: Restaurant Invoice → Payment → Expense & VAT Accounting.
However, in light of the above update, businesses should add an important control step: Does the provision of this employee benefit trigger an obligation for the company to issue an output invoice?
Accordingly, a more appropriate end-to-end control process would be: HR POLICY → EMPLOYEE BENEFIT → SUPPLIER INVOICE → PAYMENT → OUTPUT INVOICE CHECK → VAT → CIT → PIT → ACCOUNTING → SUPPORTING DOCUMENTATION / EVIDENCE.
3. Are Employee Welfare Expenses Deductible for CIT Purposes?
Under Point d, Clause 4, Article 10 of Decree No. 320/2025/ND-CP, one of the key areas businesses should monitor is the prescribed cap under which the total qualifying expenditure must not exceed one month’s average actual salary implemented during the tax year, while also satisfying the relevant conditions and supporting-document requirements.
Businesses should therefore avoid grouping all employee-related expenditures under a single "employee welfare" category and assuming that all such expenses are automatically deductible.
At a minimum, employee-related expenditures should be classified into the following categories: - Salaries and wages; - Bonuses; - Allowances; - Direct employee welfare expenses; - Training expenses; - Business travel expenses; - Insurance; - Collective employee expenses; and - Benefits that may potentially constitute taxable income for Personal Income Tax (“PIT”) purposes.
4. Our Recommendations
AI Coaching Vietnam (www.AiCoachingVietnam.com) recommends that businesses conduct a comprehensive review of their Employee Benefit Policy, rather than addressing individual transactions only when they arise.
The scope of review should consider, among others: - Employee birthday celebrations; - Year-End Parties; - Company trips / staff retreats; - Wedding and funeral support; - Medical examinations and healthcare benefits; - Insurance; - Holiday / Tet gifts; - Vouchers; - Transportation support; - Education and training support; - Special employee assistance; - Wellbeing programs; and - Non-cash bonuses and other employee benefits.
For each benefit category, businesses should assess not only the accounting treatment but also the potential Invoice, VAT, CIT and PIT implications, together with the required supporting documentation.
AI COACHING VIETNAM - RECOMMENDED ACTIONS
For businesses operating multiple employee benefit programs, we recommend implementing the following five-step review framework:
*01 | INVENTORY: Prepare a comprehensive inventory of all employee benefits. *02 | CLASSIFICATION: Classify each item into salaries, bonuses, allowances, employee welfare benefits, or other relevant categories. *03 | TAX MAPPING: Map each benefit against the applicable Invoice - VAT - CIT - PIT requirements. *04 | RECONCILIATION: Reconcile HR Policy - Employee List - General Ledger (GL) - Invoices - Payments. *05 | MONITORING: Establish a monthly or quarterly dashboard and exception reporting mechanism to identify potential compliance issues on a timely basis. (AI can support this dashboard easily).
